Prior to purchasing, you must read the following carefully as it affects your legal rights. If you do not agree with the conditions of this Waiver and Release then DO NOT proceed with the purchase. 

Agreement for Waiver and Release - Assumption of Risks & Indemnification  

BY PURCHASING ANY ITEMS FROM "The Company Wheels, aka CycleShedStore or Cycle Shed" hereafter referred to as CSS, YOU AGREE TO THE FOLLOWING WAIVER AND RELEASE: 

I, the PURCHASER being above age 18, or the Parent of the PURCHASER who is under age 18, agree as follows: 

I am aware of the risks, hazards and dangers of personal injury, death and/or disability inherent with any and all activities possible with use of CSS products. I acknowledge and understand that riding bicycles, scooters, electric bikes or participating in any bicycle-type activities are hazardous and dangerous activities that require a high degree of exercise, skill and experience. I understand that these activities can result in serious injury to the person and damage to property and voluntarily assume any and all risks of loss, damage or injury while using CSS products. I agree that I have adequate mechanical knowledge to complete the assembly of an electric bicycle, bicycle, scooter or related equipment or will take the product to a location that can complete this assembly for me. I agree to follow the maintenance schedule recommended in the Owners Manual. 

AS PURCHASER, I hereby agree to release and forever discharge CSS and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which are related to, arise out of, or are in any way connected to my participation or use of equipment or property supplied by CSS whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of CSS, it's agents, servants, employees, officers, directors, trustees and/or component and sub-component manufacturing quality, assembly, operation, durability, battery charging or storage.  

By completing this Purchase, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from CSS and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, regardless of the form of action that imposes liability, whether in negligence, intended conduct, tort or otherwise. This Agreement shall be effective and binding upon my heirs, agents, personal representatives and assigns.

I hereby certify that I am over 18 years of age. I have carefully read the foregoing and acknowledge that I understand and agree to all of the above terms and conditions. I am aware that by purchasing this product and sending payment for the item, I assume all risks and waive and release certain substantial rights that I may have or possess.
